1. Acceptance of Terms
By accessing or using the Totaliti platform ("the Service"), operated by TOTALITI INOVACAO EM TECNOLOGIA DA INFORMACAO LTDA ("Totaliti," "we," "our"), you agree to be bound by these Terms of Use. If you do not agree, you may not access or use the Service.
2. Description of Service
Totaliti provides a cloud-based process automation platform that enables users to design, execute, and monitor workflows. The Service includes a visual workflow builder, task management, analytics dashboards, integration tools, and related features as described on our website.
3. User Registration
To use the Service, you must register for a profile. You agree to provide accurate, up-to-date, and complete information during the registration process. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your profile.
4. Subscriptions and Billing
4.1 Plans: The Service is offered under different subscription plans (Basic, Professional, Enterprise) with varying features and limits as described on our Pricing page.
4.2 Fees: You agree to pay all fees associated with your chosen plan. Fees are billed in advance on a monthly or annual basis depending on your selection.
4.3 Free Trial: We offer a 14-day free trial for all plans. If you do not upgrade before the trial ends, access to paid features will be suspended.
4.4 Cancellation: You may cancel your subscription at any time. Upon cancellation, your subscription will remain active until the end of the ongoing billing period. Data is retained for 30 days after cancellation.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws
- Attempt to gain unauthorized access to any part of the Service or its systems
- Upload or transmit viruses, malware, or any malicious code
- Interfere with or disrupt the integrity or performance of the Service
- Use the Service to send unsolicited communications (spam)
6. Intellectual Property
The Service, including its code, design, logos, and documentation, is the property of Totaliti and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service during your subscription period.
7. User Data
You retain all rights to the data, documents, and content you upload or build within the Service. Totaliti will not access, use, or share your data except as necessary to provide the Service or as required by law. Our data handling practices are detailed in our Privacy Policy.
8. Service Level and Availability
We strive to maintain 99.9% uptime for the Service. Enterprise plans include a formal SLA with service credits for downtime exceeding agreed thresholds. The Service may be temporarily unavailable for scheduled maintenance, which we will communicate in advance.
9. Limitation of Liability
To the maximum extent permitted by law, Totaliti shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability for any claim is limited to the amount you have paid us in the twelve months preceding the claim.
10. Termination
We may suspend or terminate your access to the Service if you violate these Terms. You may terminate your subscription at any time through your workspace settings. Upon termination, your obligations to pay outstanding fees survive, and our rights to enforce these Terms remain in effect.
11. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through the Service. Your continued use after changes take effect constitutes acceptance of the new Terms.
12. Governing Law
These Terms are governed by the laws of the Federative Republic of Brazil. Any disputes arising from these Terms shall be resolved in the courts of São Bernardo do Campo, São Paulo, Brazil.
